This Privacy Statement explains how Alava International (“we,” “us,” “the Company,” or “our”) collects, uses, and discloses your information.  Where applicable, you consent to the use of your information as described in this Privacy Statement each time you use the Alava International web page (“the Site”).

Information you provide:  We collect personal information you provide—such as your name, username, or email address—when you use the Site, create an account, use the Contact Us function, apply for employment, or interact with us at in-person events.

Third Party Information:  We may collect information about you from third parties, including business and marketing partners.  This includes your contact information (if any) from marketing partners engaged in lawful joint marketing or co-branding activities, your IP address, location data from other providers to display information on the Site relevant to your location, and data from your social networks.

Employment Applicants:  We may also collect and lawfully use data provided by employment applicants on our Sites or through offline means in connection with employment opportunities.

For legitimate business reasons, it is conceivable that Alava International might disclose certain aspects of your personal information to Grupo Alava affiliates.  Otherwise, we make personal information of certain kinds available generally only to Company personnel for legitimate Company purposes (e.g., recruitment or required compliance) or to strategic partners working with the Company to assist us with our Site and broader efforts.  We will never share your personal information with third parties for their own marketing purposes without your prior express consent.  The Agreed Terms of Use also govern disclosures.

SERVICE PROVIDERS

We may share personal information with companies that provide services to us such as website hosting, email, data analytics, research, surveys and other measures.  These companies are obligated to protect your information and may be located wherever we operate.

CORPORATE AFFILIATES AND CORPORATE BUSINESS TRANSACTIONS

We may share personal information with Alava International-affiliated companies for legitimate business reasons.  For example, in the event of a merger, reorganization, acquisition, joint venture, assignment, spin-off, transfer, bankruptcy, or sale or disposition of portions of our business, we may transfer your personal information to the other party to the relevant transaction.

LEGAL COMPLIANCE AND SECURITY

EMPLOYMENT APPLICANTS

In order to consider individuals for employment and contractor opportunities, it may be necessary to disclose personal identifying information within the Company for recruitment, on-boarding, and compliance with the Company’s Equal Employment Opportunity and other legal obligations.

YOUR RIGHTS

We take reasonable steps to ensure that your personal information is accurate, complete, and up-to-date.  Depending on where you live, you may have the right to access, correct, or delete the personal information that we collect.  You may also be entitled to object to or restrict, at any time, the further processing of your personal information, and to receive your personal information in a structured and standard format.  You may lodge a complaint at any time with us or with a competent data protection authority regarding the processing of your personal information.

To protect the privacy and the security of your personal information, we may ask information from you to allow us to confirm your identity and right to access such information, as well as to search for and provide you with the personal information we maintain.  There are instances where applicable laws or regulatory requirements allow or even require us to refuse to provide or delete personal information that we maintain.  Contact Us to exercise these rights and we will respond in under 30 days.

CALIFORNIA PRIVACY RIGHTS

We disclose personal information only to third parties who directly assisting the Company and no others.  If you are a California resident, California law nonetheless permits you to ask for information from us about disclosures of your personal information to third parties for direct marketing purposes.  To make such a request, please Contact Us and include “California Privacy Rights Request” in the subject line.  Information on covered sharing, in the unlikely event any has occurred, will be included in our response.

CLOSING ACCOUNTS

To close a user account, please Contact Us.  If you close your account, we have no obligation to retain your information and may delete any or all of it without liability.  We may retain information related to you, however, if we believe it may be necessary to prevent fraud or future abuse, if retention is required by law, or for legitimate purposes such as data analysis, account recovery, audits, or enforcing our rights and obligations under the Agreed Terms of Use or other agreements.

THIRD-PARTY WEBSITES AND SERVICES

Our Site may allow you to access third-party websites, products, and services.  We are not responsible for third-party privacy practices or for third-party information on products or services.  Our Privacy Statement applies strictly to information collected by us.  We encourage you to read privacy policies of third parties before using their websites, products, or services.

INFORMATION SECURITY, INTEGRITY AND RETENTION

It is essential to take precautions to protect against unauthorized access to your Alava International user account, if any.  If you believe the security of your account or personal information has been compromised, please Contact Us immediately.  Despite best efforts, no security system is impenetrable.  In the event of a security breach, we will promptly notify you and the authorities as required by law.  We retain your personal information for only as long as it is necessary to fulfill purposes outlined in this Privacy Statement, unless a longer retention period is required or permitted by law.

Children

No person under eighteen years of age should use the Site.  The Company does not intend to collect or use personal information from persons under eighteen years of age, and will not do so knowingly.  If Alava International becomes aware that it collected personal information from a person under eighteen years of age and is asked to delete such information from its databases, it will comply.  Please Contact Us immediately if you believe a person under eighteen provided personal information to the Company.

If you are a California resident under eighteen years of age and a registered user of the Site, California law permits you to request and obtain removal of content or information you have publicly posted.  To make such a request, please Contact Us with specific information about where the content or information is posted and attesting that you posted it.

INFORMATION TRANSFERS, STORAGE, AND PROCESSING GLOBALLY

The Site is controlled and operated by Alava International’s offices (or its licensees or agents) in Texas, U.S.A.  The Site is not intended to subject the Company to the jurisdiction of any other territory, state, country, or union of countries.  THE COMPANY DOES NOT WARRANT THAT THIS SITE OR ANY PART OF IT IS APPROPRIATE FOR USE OUTSIDE THE U.S.A.  Use of the Site is voluntarily.  Users access it at their own risk and their own responsibility under applicable law.

PRIVACY STATEMENT CHANGES

Periodically we may change this Privacy Statement for a variety of reasons though we expect most changes to be minor.  The Company will indicate a change on the Site by changing the “Last Modified” date legend at the beginning of the Privacy Statement.  Your continuing use of the Site thereafter constitutes acceptance of the Privacy Statement changes.  If you disagree with the changes, please suspend use of the Site and Contact Us about closing a user account you may have opened.
